2019 Annual Meeting Minutes

December 12, 2019

Meeting called to order at 7:15 PM at 28 Spanish Waters Dr.

Reading and approval of Minutes:

Minutes from 2018 were read by Secretary, Tony Tempesta. They were accepted as read, seconded and approved.

Treasurers report:

Vern Voigt, treasurer, reviewed the expenditures of the past year. It was recommended that the annual dues for the coming year be set at $250.00. (See attached Budget and expenditures for 2018/2019)

A motion was made, seconded and the board voted that the proposed budget and dues be accepted as presented.

Old Business:

Concerns were expressed that cars parked on the roadway impede traffic especially on Mondays when garbage trucks and lawn mowing services are active. The board has checked and there are no ordinances or laws which prohibit parking on the street or overnight, but any thing that residents could do to alleviate the problem would be greatly appreciated.

All garbage cans are to be removed from the street after pick up and stored out of sight. Owners will be notified by the SWHOA Compliance manager to bring them in. Failure to do so will result in a fine.

New Business:

Sidewalk damage at Entrance:Early this past summer the north sidewalks in the common grounds were being torn up by construction, breaking pipes and underground wires. The problem was resolved and lawn restored.

Compliance Issues: The Board will continue to enforce the the HOA regulations and violators will be advised of non-compliance and if they remain in non-compliance, they will be fined.

Beach Walkover Issues:At times the SWHOA Walkover has been taken over by non residents. On one occasion, a group of more than 20 occupied it and made it unavailable to our residents. In another incident someone was living on it. Unauthorized usage presents a liability to the association A new gate with no trespassing and “Keep out” signs was erected to help prevent future problems.

Verona(ICI Subdivision):

ICI has started construction in their new subdivision just to our north. Their legal team has informed us that a survey is being conducted so that a wall can be constructed between the properties. The Initial survey indicates that some Spanish Water’s property fences are on ICI property. Home owners with this problem will be notified by letter from ICI and the fences will be

removed so that a wall can be constructed. They assure us that the wall be visually attractive. Homeowners will then be able to landscape up to the new wall.

ICI has also indicated that they want to remove telephone poles along their property on A1A and put the wires underground. The Condo complex to their north has agreed to participate in their request. It was the general consensus at the meeting that SWHOA would agree to their plans as long as there was no financial responsibility for Spanish Waters Homeowners.

They invited residents of Spanish Waters to an Open House at their model home. R.Voigt made a motion to that effect, it was 2nd . Voted.

Entrance Sign Lighting:The lighting on the signs at the front of our street are out. V. Voigt will investigate.

Corner of Marden Dr. and Spanish Waters Dr. SWHOA Owner, R. Marchesi and ICI Homes are collaborating on landscaping to enhance that area to the benefit of Spanish Waters and Verona.

Board Of Appeals:
Leslie Gray and Rosemarie Jaqoues volunteered and were appointed to to the Appeals Commitee. R. Voight moved to accept the appointments, 2
nd. Voted.

Board Of Directors:
R. Voight moved to retain the Board Of Directors as is, 2
nd. Voted.

Adjournment: It was moved, seconded to adjourn the meeting and unanimously agreed to at 8:pm. Refreshments and a Holiday gathering for neighbors followed.

December 19, 2018

Meeting called to order at 7:15 PM at 28 Spanish Waters Dr.

Reading and approval of Minutes:

It was moved to waive reading of the minutes since they had been distributed earlier in the year and there were no objections.  It was seconded and approved.

Treasurers report:

Vern Voigt, treasurer,  reviewed the expenditures of the past year.  He reported that the collection of all over due accounts plus interest benefited the HOA budget allowing us to end the year with a surplus of $8,4088.00. It was recommended and approved that this surplus should be retained for repairs in the event of future hurricane damage to our walkover.

It was recommended that the 2018 operating budget of $6,250.00 remain the same for 2019. Dues for 2019 will be $250, the same as the previous year.

A motion was made, seconded and the board voted that the proposed budget and dues be accepted as presented.

New Business:

Compliance Issues:  Keeping some homeowners in compliance with the HOA regulations continues to be a significant problem even though fines have been levied and collected.  The Board will continue to enforce the regulations and violators will continue to be advised of non-compliance and if they remain in non-compliance,  they will be fined.

Vacant Lot in the South East corner of Spanish Waters:  With the interest in building activity in surrounding properties some homeowners have expressed concern about what might happen with this vacant lot.Currently this property is listed as a lot that is dedicated to Volusia County for the temporary usage of a Sewage Treatment Plant.  The sewage plant is long gone and the property has been vacant for a number of years.  A sub committee will be formed to investigate the true ownership and once that has been determined will proceed with a recommendation.

Emmers Property to the north of Spanish Waters:  G. St. Pierre reported that a recent conversation with Attorney Dick Smith of ICI indicated that Plans have not changed and things are proceeding as previously stated.

Election of Board Member: The position of Treasurer was open, Vern Voigt was nominated for the position. A motion was made, seconded and voted on that V. Voigt be Treasurer for the next three years.

Minutes for 2016 Annual Homeowner’s Meeting December 4, 2016

 

Call to Order: The annual meeting of the Spanish Waters Homeowner’s Association was called to order by George St. Pierre, President, at 6:37pm December 4, 2016 at 28 Spanish Waters Dr in Ormond Beach.

Minutes: Secretary, Tony Tempesta, read previous minutes. There were no corrections and it was moved they be accepted as read.

Motion was seconded/approved.

 

Treasurer’s Report: Treasurer, Vern Voigt sent an Excel Budget report for 2016 and a proposed budget for 2017.  Ending balance for 2016 was $2607. 

 

Note: Two homes are in arrears for dues-multiple years and SWHOA compliance manager is working with the association’s lawyer to pursue and file any required notices and follow procedures for these properties as required by the HOA docs.

 

Homeowner assessments were increased for 2017 to help build up reserves again, pay legal fees and maintain a sufficient minimum bank balance to avoid additional fees. It is hoped that this will be a temporary increase for 2017 to recover from high expenditures for repair/rebuilding walkover and legal fees.

The dues for 2017 will be $350/yr due by January 31, 2017. 

It was moved to accept the budget proposed by the Treasurer.

The board members voted to approve the 2017 budget and dues increase.

Common Grounds Report:

Tony Tempesta discussed additional repairs to the walkover after the hurricane. The HOA thanks George St. Pierre and George Farnick for volunteering their time and labor to help fix the damages to the walkover by the storm.

 

Neighborhood Watch

Karin Tempesta reported that coyotes have been spotted on the barrier island and also in the undeveloped Emmer’s property---the vacant circle just north of Spanish Waters.

Owners are advised not to feed strays or leave any water/food or unsecured garbage outside since this will attract coyotes.  Pets should not be allowed out unattended especially after sundown. Many area cats have already disappeared.  Coyotes usually do not bother humans.  More information about what residents can do to discourage coyotes and encourage them to leave an area can be found on: http://www.humanesociety.org/animals/coyotes/tips/hazing_guidelines.html

 

Karin also informed owners of a new, free local online organization especially for our area: Nextdoor Upper-Ormond-by-the–Sea.  Members report items of concern or interest to Ormond by the Sea residents. Coyote sightings, car break ins and other useful info is also on this site.

Zoning Changes: No additional information was available about the proposed Townhouse development to the north or when it would break ground. Several Spanish Waters homeowners went to Deland to object to the development at the August zoning hearing.  The News Journal interviewed some Spanish Waters residents and published an article about homeowner concerns.

 

Election of Board Members:

There were no volunteers for board vacancies.  Existing board members agreed to continue to volunteer.

Members of the SWHOA Appeals committee remain the same.

Minutes for 2015 Annual Homeowner’s Meeting December 6, 2015

Call to Order: The annual meeting of the Spanish Waters Homeowner’s Association was called to order by George St. Pierre, President, at 6:37pm December 6, 2015 at 14 Spanish Waters Dr in Ormond Beach.

Minutes: Prior minutes were read by Tony Tempesta. There were no corrections and it was moved they be accepted as read. Motion was seconded/approved.

Treasurer’s Report: Treasurer, Vern Voigt sent an Excel report for 2015 and a proposed budget for 2016. Tony Tempesta reviewed budget expenditures in 2015 and discussed repairs to the walkover and replacing electrical feeds.
2015 ended with a balance of $1600 after paying recent electrical repairs. Treasurer, Vern Voigt, felt this would be an adequate surplus for 2016, since no major expenditures are anticipated. Homeowner assessments would remain the same $250/year for 2016. (Note: Dues are not being paid by the vacant property at 12 Spanish Waters. The final disposition of this property is not known at this time; it may already be in foreclosure by the bank.) It was moved to accept the budget proposed by the Treasurer. The board voted to approve the 2016 budget.

Tony Tempesta reported that the sprinkler system for the entrance grounds was repaired along with electrical feeds. These two items are periodically a problem for our HOA due to the harsh salt/wind environment at the beach.

Neighborhood Watch

Karin Tempesta reported that county deputies would still like to see additional night lighting by homeowners on our street. Neighbors may wish to add inexpensive LED landscape lighting to help light up their homes and street.

Notices are sent and applicable fines are being levied and collected following the steps outlined by the state’s HOA statutes. The manager is communicating with the board regarding the enforcement of SWHOA’s governing documents.

A request was made for volunteers to serve on the board. George agreed to serve another term as treasurer. It was moved and seconded that George St. Pierre remain on the board.

Minutes for 2014 Annual Homeowner’s Meeting Nov 9, 2014

 

Call to Order: The annual meeting of the Spanish Waters Homeowner’s Association was called to order by George St. Pierre, President, at 6:35pm November 9, 2014 at 28 Spanish Waters Dr in Ormond Beach.

 

Board Members Present: George St. Pierre, President, Vern Voigt, Treasurer and Tony Tempesta, Secretary.

 

Minutes: Prior minutes were read by Tony Tempesta. George St. Pierre moved they be accepted as read. Motion was seconded and approved.

 

Treasurer’s Report: Vern Voigt reviewed budget expenditures in 2014 and discussed some upcoming major expenses to repair the walkover.  Currently there is a surplus of $9000.  It was determined that an adequate surplus remained on hand for repairs and any emergencies. Therefore homeowner assessments would remain the same $250/year due by January 31, 2015. Dues are not being paid by the vacant property at 12 Spanish Waters. The board voted to approve the 2015 budget as proposed by the Treasurer’s Report.

Common Grounds Report:

Tony Tempesta reported that the sprinkler system for the entrance grounds was down again.  This is periodically a problem.  The irrigation repair company has been notified and will do repairs. 

It was also reported that a small “Private Property” sign on the walk-over had been stolen. It will need to be replaced.

Lights will be placed in front of the new entrance sign (north side).

Walkover needs some serious repairs and bids will need to be taken.

 

Neighborhood Watch

Karin Tempesta reported that county deputies would still like to see additional nighttime lighting by homeowners on our street. Deputies recommend keeping shrubbery trimmed around doorways, windows for improved visibility and safety.

 

Mary Plaza discussed problems with some rude and careless people that use the north neighboring undeveloped property as an “off leash” dog park against county regulations. She suggested more frequent patrols of this property by the deputies.

Minutes for March 17, 2014 Board Meeting

Meeting Posted on March 6 via Electronic Mail and/or Hand Delivery

Call to Order: Board Meeting of the Spanish Waters Homeowner’s Association was called to order by George St. Pierre, President, at 3:05 pm on March 17, 2014 at 28 Spanish Waters Dr in Ormond Beach.

Board Members Present: George St. Pierre, Joe Plaza, Verne Voigt, Tony Tempesta and Jackie Chorbak.

Proof of Notice: Notice of meeting was posted on March 6, 2014 via electronic mail and/or hand delivery.

Minutes: Secretary, Tony Tempesta, read the Minutes of the last meeting. Joe Plaza moved that they be accepted as read. Motion was seconded and approved.

Reduction of Board from 5 members to 3.  A discussion was held about reducing the number of board members from 5 to 3 as permitted by State law and SWHOA governing docs.  Joe Plaza and Jackie Chorbak tendered their resignations from the board effective immediately. Their resignations were accepted by President, George St. Pierre.

2014 Board : President, George St. Pierre, Treasurer, Verne Voigt and Secretary, Tony Tempesta.

Appeals Committee  The Board discussed the State requirements for an Appeals Committee for the SWHOA.  The new committee would consist of 3 volunteers, independent of the Board.

A request for volunteers was made.  Joe Plaza, Jackie Chorbak and George Farinick volunteered to serve on the new committee. The Board voted affirmatively and unanimously to appoint all three volunteers and initially stagger their terms:

·      1 year-Jackie Chorbak

·      2 years-George Farinick

·      3 years- Joe Plaza

After this initial staggering, subsequent terms for volunteers would be for 3 years.

Review and Update Letter of Policy The board reviewed and unanimously approved updates to the Letter of Policy adopted at the 2012 Annual Meeting.

Rules and Regulations  The board reviewed the proposed Rules and Regulations for the SWHOA and unanimously voted to adopt them and post them on the new website and send a printed copy to all homeowners.

Fine and Enforcement Plan was discussed and unanimously approved by the Board.  The plan would follow state guidelines and be implemented by the CAM (Violations Manager).  The plan would be posted on the website and printed copies would be distributed to all homeowners.

Entrance Lighting  The board discussed and approved additional lighting for the new entrance sign and for some of the trees.

Adjournment  The meeting was adjourned at 4:30pm.

Minutes for 2013 Annual Homeowner’s Meeting Nov 10, 2013

Call to Order: The annual meeting of the Spanish Waters Homeowner’s Association was called to order by George St. Pierre, President, at 6:35pm November 10, 2014 at 28 Spanish Waters Dr in Ormond Beach.

Board Members Present: George St. Pierre, Mary Plaza, John Jacobs and Tony Tempesta. There was a quorum of the homeowners either in person or by proxy forms submitted.

Minutes: The minutes were read by Tony Tempesta, Sect.  Mary Plaza, Vice President, moved that they be accepted as read.  Motion was seconded and approved.

Treasurer’s Report: John Jacobs reviewed budget expenditures in lieu of Vern Voigt. It was determined that adequate surpluses remain on hand for any emergencies therefore homeowner assessments would remain the same $250/year due by January 31, 2014. Mary Plaza moved to accept the report and 2014 budget.  Tony Tempesta seconded.  All were in favor.

Neighborhood Watch

Karin Tempesta reported that county deputies would still like to see additional nighttime lighting on our street. They have also observed garage doors up, which is an invitation to ‘opportunity’ thieves.  The deputies recommended keeping shrubbery trimmed around doorways, windows for improved visibility and safety. A discussion followed of using some of the Association’s surplus monies to subsidize improved homeowner lighting. The idea was rejected.

HOA Covenant Enforcement Policy:

Complaints were heard from homeowners about properties and/or grounds that were not being maintained in accordance with the SWHOA Covenants. It was noted that some of the homeowners, who had been advised by the Association of violations, were defiant and un-cooperative about bringing their property into compliance.

A discussion followed and it was unanimously agreed by all that the Association should engage a neutral outside CAM (Community Association Manager) to handle just the violations and help establish a protocol for fines/liens. A separate committee for compliance would need to be established.


Some homeowners continue to be in violation of SWHOA rules/covenants despite repeated notices by the Association. The state does allow for Associations to fine and lien members in violation. Further information will be gathered and steps will be taken by the board to help enforce our governing documents as required by state law. It was moved that Adriana Hollander, a licensed CAM, be contacted on a case by case basis to handle violations.

There was already approval at the previous annual meeting to draft a Letter of Violations Policy, which outlines procedures of fines/liens to help enforce our neighborhood’s covenants. A Compliance Committee will be established at a future board meeting.

New Entrance Sign for North side of Street.

Tony Tempesta reported that a new sign for the north side of the entrance had been ordered and would be installed by George St. Pierre and Tony Tempesta. A small replacement for the old, weathered walkover sign would also be installed.

Election of Board Members:

Two board member’s terms were up: Mary Plaza, Vern Voigt.

John Jacobs announced he would need to resign from treasurer since he was selling his home. There were 3 open board positions.

Mary Plaza nominated Joe Plaza for the board since she declined to stay on. It was unanimously approved. It was also moved that Vern Voigt remain on the board.  Jackie Chorbak volunteered for the remaining open position. The motions were seconded; all were in favor.
